Pamela Springer Courses Terms and Conditions

Thank you for choosing Global Skin Solutions, LLC (“we”, “our”, “us”).  We encourage you to read these terms and conditions (the “Terms”) carefully and to contact us if you have any questions.  

These Terms govern our relationship with you when you register for education courses and/or classes (“Course” or “Courses”) via our website accessible at https://pamelaspringer.com (the “Website”).  By registering for one of our Courses, you acknowledge and agree to be bound by the Terms set forth in this agreement as well as the policies outlined in the event description, and general guidelines presented.  These Terms, together with the policies and general guidelines presented, shall constitute the entire agreement between you and Global Skin Solutions concerning your registration for and participation in a Course. Should a situation arise that is not covered by these Terms, we reserve the right to take any reasonable and fair action that we think appropriate.  

If you do not agree to be bound by these Terms, then please do not register for this Course.  We reserve the right at any time, at our sole discretion, to change or otherwise modify these Terms without prior notice.

1. Eligibility

Each Course offered via our Website is intended for individuals who (i) are adults (or, if underage, duly authorized by their legal representative to place an order via our Website); and (ii) enjoy full legal capacity to place orders via our Website.  You will need sufficient fluency in the language in which the Course is presented.

We hereby reserve the right to request from time to time that you provide an identification document evidencing your age and/or said legal representative’s authorization. We reserve the right not to respond to an order and/or to exclude from any customer who fails to satisfy such request or meet the requirements under this section.

2. Payment and Registration

Courses offered for sale via our Website are those displayed on the date you browse our Website. Global Skin Solutions reserves the right to modify prices from time to time, provided however that the Course will be charged based on the price as applicable upon registration of the order.

The fee for the Course (the “Fee”) must be paid in full at the time of registration. Registration is not complete until Global Skin Solutions has received full payment of the Fee. You are responsible for non-payment, even if the Fee is being paid by a third party. After successful registration, you will receive an e-mail from Global Skin Solutions acknowledging your enrollment in the Course.

If there is a dispute about payment of any Course Fee (or any portion thereof), then we may at our sole discretion suspend your participation in the Course for the period of the dispute.

2.1 Order Process

You must access our Website before placing an order. By accessing our Website to place an order, you agree to be bound by our Terms of Use, accessible at https://pamelaspringer.com/terms-of-use/ and our Privacy Policy, accessible at https://pamelaspringer.com/privacy-policy/.

You can view and select the Courses offered for sale on the date you browse our Website. When you are finished selecting a Course, you may order and register for the Course by clicking on the dedicated “Checkout” button. A new page will be displayed that will ask you to enter specific details, including but not limited to your full name, shipping address, email address, phone number and billing information. You agree to fill out the provided information in good faith, and you also acknowledge that the data disclosed to Global Skin Solutions is correct and shall constitute valid evidence of your identity.  Your personal data will be governed by our Privacy Policy, accessible at https://pamelaspringer.com/privacy-policy/.

Before clicking on the dedicated button to complete your purchase, you will be required to read these Terms and confirm that you agree to these Terms by completing an acceptance confirmation action required on our Website (e.g., ticking a box). 

Once you confirm your acceptance of these Terms, and after we validate your payment, a printable and downloadable version of your order recap will be displayed. An order confirmation email shall be sent promptly by Global Skin Solutions to the email address provided by you.

To protect Global Skin Solutions from any abusive practices, and in the event that Global Skin Solutions or the online payment service provider suspect an order of being fraudulent, we reserve the right to request that you (before processing the order) provide additional documentary evidence (including your ID) in order to check whether it is fraudulent or not.

If you fail to respond within fourteen (14) days following Global Skin Solutions or the online payment service provider’s request, then the order shall be cancelled and no payment shall be cashed by Global Skin Solutions. If payment for the order has already been cashed, then Global Skin Solutions shall refund it within fourteen (14) days following the end of the abovementioned period of time, using the same payment method as that used by you.

In any event, Global Skin Solutions reserves the right to refuse any order in case of any (i) breach of these Terms; (ii) existing dispute with you, (iii) payment default of all or part of any order by you; (iv) a payment authorization by credit card being denied by banking institutions; (v) payment default or partial payment.

3. Cancellation

3.1 Cancellation by You 

Your right to cancel your order with Global Skin Solutions and obtain a refund depends on the nature of the Course that you have paid for.

Online Courses:

Online Courses are nonrefundable. 

In-Person Courses:

You have the right to cancel your in-person Course with Global Skin Solutions at any time up to 30 days before the Course begins. Upon successful cancellation of a course by you within the allowable cancellation period as set out above, your payment will be refunded to your original payment card. After the period as set out above, no refund or compensation of any type will be possible. Global Skin Solutions will only deviate from this in the case of exceptional circumstances to be determined at Global Skin Solution’s sole discretion.

To exercise your cancellation rights as set out above, please inform us in writing by email to info@globalskin-solutions.com.  Please write the name of your Course in the subject-line of your email.  For any queries on the scope, contents or instructions related to the exercise of your cancellation right, you may contact Global Skin Solutions by using the contact details set out under the “Contact Us” section below.

3.2 Cancellation by Global Skin Solutions

Global Skin Solutions offers Courses subject to availability. From time to time, whether due to circumstances of force majeure, circumstances outside of Global Skin Solution’s reasonable contemplation or control, or other circumstances (including, but not limited to, availability of training staff or particularly low numbers of purchasers booked on particular Courses), Global Skin Solutions may need to reschedule or cancel scheduled Courses. 

If Global Skin Solutions cancels or reschedules any Courses that you have booked, then Global Skin Solutions will make reasonable efforts to contact you by email and/or phone to let you know.  You are responsible for updating us in the event of a change to your information (for example, your name or email address).  

If your Course is cancelled, then wherever possible, we will offer you the option of being transferred to another equivalent Course at an alternative date and time (subject to availability). If there is no suitable alternative available, then Global Skin Solutions will notify you of the cancellation and process a refund of the full amount paid for such Course to your original payment card.  For partial cancellation, such refunds will be made on a proportionate basis.

For the avoidance of doubt, in the event of cancellation of Courses by Global Skin Solutions, Global Skin Solutions shall not be responsible for any costs or losses incurred by you because of any cancellation, including but not limited to loss of earnings, loss of profits or the costs of any pre-booked transport or accommodation.

4. Course Content

The Course description is intended to indicate only the general nature of the Course and does not guarantee content. Global Skin Solutions reserves the right to amend the Course and alter details at its discretion. Before registering for any Course, you are responsible for establishing the relevance and suitability of the Course for your individual requirements, through consideration of the information supplied through our Website, and asking questions, if necessary. 

TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, ALL COURSES AND THEIR CONTENT ARE PROVIDED “AS IS” WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, IN RESPECT THEREOF, AND IN PARTICULAR, WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE QUALITY OF THE COURSE CONTENT OR THE FITNESS OF THE COURSE CONTENT FOR THE PURPOSE FOR WHICH YOU ACQUIRED IT.

The information, including but not limited to, text, graphics, images and other material appearing via the Course and/or on our Website are for informational purposes only. No material presented via the Course and/or on our Website is intended to be a substitute for professional medical advice, diagnosis or treatment. Additionally, you agree that Pamela Springer is not, nor holding herself out to be a doctor/physician, nurse, physician’s assistant, advanced practice nurse, or any other medical professional (“Medical Provider”).  As a continuing education provider, Pamela educates licensed aestheticians, healthcare and medical practitioners on a variety of topics, including but not limited to advanced aesthetics techniques, therapeutically challenging pigment disorders, and cultural diversity. Always seek the advice of your physician or other qualified health care provider with any questions you may have regarding a medical condition or treatment and before undertaking a new health care regimen, and never disregard professional medical advice or delay in seeking it.  

5. Intellectual property

Except where expressly stated to the contrary, trademarks and copyright in the HTML, text, graphics, audio clips, video clips, source and/or object code and all other works contained on the Website and/or Courses or otherwise provided to attendees by Global Skin Solutions, is owned by us or licensed to us, and we assert and reserve all of our rights in this regard. Access to or use of our services and Courses will not in any way result in an assignment or license of any intellectual property owned by us or any other party.

6. Attendee Conduct

Global Skin Solutions grants you a limited license to access and use the content in connection with the Course you have registered for.  As a condition of such license, you agree that:

• All materials – including but not limited to text, photographs, video, audio, images and any other content – appearing via the Course and/or on our Website are protected by copyrights and other proprietary rights belonging to Global Skin Solutions and/or other third parties. You agree to abide by all applicable laws regarding copyrights, trademarks, publicity rights and privacy rights in the United States and any other jurisdiction from which you are accessing the Website.

 

• You may not copy, reproduce, duplicate, distribute, disseminate, publish, post, display, perform, modify, create derivative works from, upload to, transmit, or in any way exploit any content from the Course and/or on the Website without Global Skin Solutions’ prior express written consent.  You may not sell or offer for sale any of the content. Using, displaying or otherwise making available the Course content (or any portion thereof), or any other materials, to third parties in an electronic or print format that enables it to be downloaded or distributed to any third party via a mobile device, or shared in any peer-to-peer or similar file sharing arrangement, or enabling the distribution of the Course content by any other means, is strictly prohibited without Global Skin Solutions’ prior express written consent. 

 

• The Courses may enable you to share your own content with Global Skin Solutions and fellow attendees. You retain all intellectual property rights in, and are responsible for, the content that you share, however you specifically agree and consent that we will be entitled to use (in our discretion) all content shared by you for both commercial and non-commercial purposes. 

 

• We may utilize photography and videography during our Courses. You agree and consent to Global Skin Solutions to use your likeness in any photography, video or other digital media (the “Media”) taken or to be taken during the Course in any and all publications and promotional campaigns, whether print or web-based (the “Publications”). You authorize Global Skin Solutions to copy, edit, enhance, crop or otherwise alter any Media without your prior approval or inspection. You understand and agree that the Media are the intellectual property of Global Skin Solutions and will not be returned to you. You also acknowledge that you are not entitled to any compensation or royalties with respect to the use of the Media. 

 

• You agree to maintain the security of any ID and password required for accessing an online Course. Only attendees who are registered for a Class may participate in that Course. You may not permit any other person to participate in the Course on your behalf, and/or impersonate any other person in dealing with us. You will notify us promptly if you become aware of any unauthorized use of your credentials. We take security seriously, but as the user, you accept all risks of any unauthorized access that could occur regarding your information.

 

• You agree that any violation of these Terms may result in your expulsion from the Course, and you may be subjected to fines and penalties. We also reserve the right to remove you from the Course and/or the Website if you do not respect Course guidelines, our staff and/or fellow attendees.

6. Technology Requirements

Our online Courses are facilitated through Zoom. It is your responsibility to ensure that you have the proper hardware and software requirements, along with access to Wi-Fi, to be able to participate in the Course. 

We will not be responsible for any errors or failures in relation to your ability to access the Course, the Website or any related materials, including where such errors or failures are caused by: (i) a loss of connection on Global Skin Solutions’ or your end; (ii) a breakdown or problems with the online software and/or (iii) a breakdown or problems with your internet connection, computer or system.

7. Accessibility Statement

Global Skin Solutions is committed to providing Courses that are accessible to the widest possible audience. We are actively working to increase the accessibility and usability of our Website for all our attendees, including those with disabilities. 8. Limitation of Liability and Indemnity

We will not, under any circumstances, be liable for any costs, claims, damages, or loss that you may sustain or suffer as a result of registering for and/or participating in any Course (or other services offered by us) which is not relevant, suitable or does not meet your requirements, and/or the requirements of any relevant industry or commercial body. Under no circumstances do we guarantee your suitability for a particular Course based on the levels of difficulty. We cannot, under any circumstances, be held liable to you for any costs, claims, damages or loss, if after the completion of a Course you are not able to obtain employment or a promotion within your chosen field of study or attain any other outcome you may believe completing a Course will assist you to attaining.

To the maximum extent permitted by law, you agree that we will not be liable for any cost, claims, damages, including, without limitation, indirect, extrinsic, special, penal, punitive, exemplary or consequential loss (such as loss of profits, business, goodwill, revenue or anticipated savings) or other damages of any kind, penalties, actions, judgments, suits, expenses, disbursements, fines or other amounts that you or any third party might suffer relating to or arising from these Terms, your participation in a Course, or the termination of a Course, for any reason, whether or not anyone anticipated or should have anticipated that damages would occur. In no event will Global Skin Solutions’ aggregate liability to you for any and all claims exceed the total amount of fees received by Global Skin Solutions from you in the six months preceding any cause of action.

You acknowledge and agree that the disclaimers and limitations of liability set forth in these Terms reflect a reasonable and fair allocation of risk between you and Global Skin Solutions, and that these limitations are an essential basis to our ability to make services available to you on an economically feasible basis.

Subject to any applicable laws, you agree to indemnify and hold us harmless in respect of any claim that a third party might bring against us that relates to or arises from these Terms arising from your registration for and/ or participation in a Course. This indemnity includes claims arising from your use of the Course in a way that does not comply with these Terms or the unauthorized or prohibited access of your profile by a third party. This indemnity also includes all liability or loss that we might suffer because of a claim, including legal costs on the highest permissible scale and any additional legal and collection costs.

9. Miscellaneous 

9.1 Dispute Resolution 

If any dispute should arise between you and Global Skin Solutions, then please contact us at info@globalskin-solutions.  If a mutually-satisfactory outcome, course of action, or conclusion cannot be reached between you and Global Skin Solutions, then you agree that it will be resolved individually, without resort to any form of class action, and, to the extent compliant with applicable law, through mediation and arbitration only. To the extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms, your rights and obligations, or the rights and obligations of Global Skin Solutions, shall be governed by, and construed in accordance with, the laws of Florida without giving effect to any conflict of laws provisions therein. As a consumer, you may benefit from certain mandatory provisions of the law of the country in which you are resident. Nothing in these terms and conditions, including this “Dispute Resolution” clause, affects your rights as a consumer to rely on such mandatory provisions of local law.

Nothing in this section will restrict our right to apply to a competent court for relief should our intellectual property rights be violated or threatened, or where otherwise appropriate to obtain urgent, injunctive or equitable relief.

9.2 Revision of Terms

We reserve the right to revise these Terms at our sole discretion from time to time. These revisions will become effective immediately on being posted to the Website, however, for all material changes to the Terms, we will take reasonable steps to notify you of such changes if you are registered for a Course at the time when such changes come into effect.

9.3 Conflict 

If any aspect of these Terms conflicts with any information provided on our Website or in information packs or other Course materials, these Terms will prevail unless expressly stated otherwise.

9.4 Severability

In the event that any part of these Terms is found to be partially or fully unenforceable, this will not affect the application or enforceability of the remainder of these Terms.

9.5 Assignment

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Global Skin Solutions without restriction.

9.6 No Waiver 

If Global Skin Solutions chooses not to enforce any part of these Terms, then this does not mean that it cannot do so at a later time. No waiver of any term shall be deemed a further or continuing waiver of such term.
